Dear Mr. Appelberg and Mr. Shaffer:

First, I will start off by saying I will be interested to see if this letter is posted on the onwer's forum since it will not reflect either of you in a "good light."

Although currently I could not find any material on the owner's forum regarding a so called confrontation between the current Board President Mr. Jackson and an "owner" at a recent board meeting, it is my understanding that there was a reference to this on the Casa Ybel website. However, I also happen to know that you Mr. Appleberg called Mr. Jackson a liar when you were again proved to in fact be the liar. And according to everyone's accounting of that incident that was present, except for yours Mr. Appelberg, you were the one totally out of line and that your depiction of that meeting was inaccurate. Mr. Jackson never threatened you with any type of bodily harm except to stand up and tell you he would not take you calling him a liar. I feel and I think most people would agree that most people would get angry over someone calling them a liar. Did you know that some owners did write some of the other board members and that the board members wrote letters back with an accurate accounting of that meeting and other meetings? If you did know why have you not posted a message letting the owners know other board members do not agree with you?

I found the reading of the contract signed by Mr. Jackson that appears on the owner's forum to be very interesting. I also found it interesting that nowhere do you state that when you questioned this contract at a board meeting, because you supposedly knew nothing about this contract, that the minutes of the board meeting reflected that not only did you know about it but that you were present and voted for the passage of this contract. Your excuse that it was discussed before lunch or that you must not have been paying attention only shows your ignorance. In addition, those comments only lead me to believe that you should not be serving on this or any other board. And it is my understanding that is not the first time you do not remember voting on an item in a board meeting.

As far as not sharing the owner's names with you for your website it is against the law. Mr. Jackson nor any other member of the board has the right to that list nor to the best of my knowledge do they have a copy. I noticed nowhere on your website is that fact stated. This is not Mr. Jackson or any other board member trying to hold back you personal endeavor, it is the law.

Mr. Jackson has diligently served on this board for 12 years. He is a volunteer that has wanted and done only what was best for Casa Ybel. Both of you should be ashamed at how you are presenting only your side of events on the website. You say you want a board that represents the owners why don't you start by telling the truth on your website.

Dear Ms. Taulbee
I appreciate your comments in your letter, and hope you will find they support all owners desire for open communications.
You will find that the owner's web site is not censored as opposed to our "Sand script". Your letter is placed up front as the first negative response to our plead for open communications.
Mr. Jackson has refused any communication to owners regarding this web site for 5 years, and made the board agree to censorship in communication to owners in "Owner's Forum",( which I started some 15 years ago for the purpose of opening communications, and it succeeded then..) Ask for minutes from the meetings, which were never shown to the owners.
All we are doing is to tear down the wall built by Mr. Jackson and open communications. What are we afraid of?
If you were not at the meeting, how do you know my description was inaccurate? By others say so?
Regarding the contract not to let owners know about any rental alternatives: Find the contract on this web site.
The restrictions promised to "Hospitality" were not recorded or expressed, only that it was a contract for the Hilton Management Group to be seated again in the reservation office. After all, they were evicted by the new 3rd group "Thistle Lodge Partners", also known as Casa Ybel Hospitality!
Please read the minutes from that meeting, no mention was ever given that we promised "Hospitality" not to let owners know how else to deal with rentals or sales, only the 35% solution was given to all owners through our "Sand script" as recently as a few weeks ago. What was in it for the owners?
Owners have lost hundreds of thousands of Dollars due to this exclusion.
With respect to the "law" please read the law. The board can give permission to use the list of names.
And this is not the issue.
I did not ask for a mailing list----- all I asked for was permission to place an article in the "Sand script" to inform owners of our new web site!. This has always been denied by Mr. Jackson. The Board agreed to place an article at the previous board meeting. However Mr. Jackson asked Lael Kirckpatrick to scrap it due to the fact that I had raised an issue with the State Office for Timeshare Owners. Lael reported this at a owner's meeting, where I was present, so I know Mr. Jackson did not tell the truth when he stated that the board had asked for it to be removed, he did it personally. And to ad insult to the injury he placed an article about "Hospitality's Casaybelresort.com" on the front page of the  latest issue of "Sand script" forcing owners to the 35% commission again..

Dear Ms. Taulbee,

Everyone is entitled to their opinion,...this is, after all, the reason you can voluntarily choose, or not, to become part of a Casa Ybel unit Owner's communication network...to give you the ability to air that opinion to fellow Owners, as well as to give yourself the opportunity to become aware of other Owner's opinions and concerns; Participation is strictly voluntary. There can be no law in opposition to voluntary interactive communication among Owner's, or among members of any group for that matter.

My choosing to get involved in this election is due to dissatisfaction, among many people including myself, over the past few years concerning the quality and level of service provided at Casa Ybel, and moreover the apparent lack of attention and action by the existing Board to that deterioration of service. My philosophy is: If you feel you may be able to help, or believe you have something to contribute,...get involved.

As for Mr. Appelberg's alleged encounter with Mr. Jackson at a recent Board meeting,... I cannot address that matter, nor would I presume to, since I was not present; and from your writing I gather neither were you in attendence at that meeting.

Thank you for your concern, and your opinion, Ms. Taulbee. I would hope that you can find it in your heart to recognize that people who voluntarily involve themselves in this endeavor do it for the benefit of all unit Owners at Casa Ybel. Sometimes a new point of view, a new perspective, a new approach to problems, etc. can be beneficial to all concerned; 'new' is not always bad... 'change' is very often positive.
